Welcome to VistralNova. These Terms of Use ("Terms") govern your access to and use of VistralNova's website, applications, games, digital platforms, blockchain features, content, products, and related services collectively referred to as the "Services." By accessing or using the Services, you agree to these Terms. If you do not agree with these Terms, you should not access or use the Services.
VistralNova is a Web3 gaming technology company focused on building intelligent, blockchain-powered gaming systems. Our products may include game platforms, digital asset systems, AI-driven simulation features, player interfaces, blockchain integrations, wallet-connected features, and related digital services. Our goal is to create gaming experiences where gameplay comes first, while blockchain and AI are used to support digital ownership, transparent systems, and dynamic player experiences.
You must be legally able to use the Services in your jurisdiction. By using the Services, you confirm that: You are at least the age of majority in your jurisdiction, or you have permission from a parent or legal guardian where permitted by law. You are not prohibited from using the Services under applicable laws. You will not use the Services for unlawful, fraudulent, or harmful purposes. Any information you provide to us is accurate and complete. Certain features may be restricted based on age, location, legal requirements, compliance checks, platform rules, or risk controls.
Some Services may require you to create an account, connect a digital wallet, or use third-party authentication. You are responsible for: Keeping your account credentials secure. Maintaining control of your wallet, private keys, seed phrases, and connected devices. All activity that occurs through your account or wallet. Notifying us promptly if you suspect unauthorized access. VistralNova does not control your private keys or seed phrases. We are not responsible for losses caused by your failure to secure your account, wallet, device, private keys, or access credentials.
The Services may include blockchain-related features such as NFTs, digital assets, smart contracts, ownership records, rewards, wallet connections, or other Web3 functionality. You understand and agree that: Blockchain transactions may be irreversible. Network fees, gas fees, or third-party blockchain costs may apply. Blockchain networks may experience delays, failures, congestion, or security incidents. Digital assets may have limited utility, limited liquidity, or no market value. VistralNova does not guarantee the future value, liquidity, availability, or utility of any digital asset. Digital assets are not investments unless expressly stated in a legally compliant offering document. You are responsible for reviewing all transaction details before approving any wallet transaction.
VistralNova may use AI, simulation models, algorithms, or automated systems to support gameplay features, race outcomes, digital asset behavior, recommendations, or other interactive experiences. AI-driven systems may produce variable results based on inputs, gameplay data, asset traits, environmental conditions, system rules, or simulation models. VistralNova does not guarantee specific game outcomes, specific rewards, specific asset performance, continuous access to AI-generated features, or any financial return from gameplay or digital assets. AI and simulation systems are intended to support gameplay and user experience. They are not financial, legal, tax, betting, or investment advice.
Some Services may include rewards, competitions, racing systems, progression systems, prediction-style mechanics, or game economy features. These features may be subject to additional rules, eligibility requirements, geographic restrictions, and compliance reviews. VistralNova may restrict, modify, suspend, or remove access to certain features where required by law, platform policy, operational risk, or internal compliance standards. If any feature is considered regulated gaming, gambling, betting, lottery, financial activity, or similar regulated activity, it will only be offered where VistralNova determines that the feature can be legally provided.
Some Services may require payment or involve digital transactions. Where applicable, we will aim to clearly display product or service description, price and applicable fees, payment method, delivery or access conditions, refund or cancellation terms, and any material limitations. All mandatory fees should be clearly disclosed before purchase. Unless otherwise stated at checkout or required by law: Payments are final once processed. Blockchain transaction fees are non-refundable. Digital asset transactions may be irreversible. Refunds may not be available after digital goods, access rights, or blockchain-based assets have been delivered. Nothing in these Terms limits consumer rights that cannot be excluded under applicable law.
You agree not to: Use the Services for illegal, fraudulent, abusive, or harmful activity. Attempt to hack, exploit, disrupt, or reverse engineer the Services. Use bots, scripts, automation, or unauthorized tools to manipulate gameplay, rewards, smart contracts, APIs, or platform systems. Interfere with fair play, platform security, or other users. Upload malware, harmful code, spam, or malicious content. Misrepresent your identity or impersonate another person. Violate intellectual property, privacy, or publicity rights. Use the Services for money laundering, sanctions evasion, fraud, or prohibited transactions. Circumvent geographic, compliance, or access restrictions. We may suspend or terminate access if we believe your activity creates legal, security, operational, or reputational risk.
All VistralNova software, content, branding, logos, designs, game systems, interfaces, artwork, documentation, architecture, text, graphics, and related materials are owned by VistralNova or its licensors unless otherwise stated. You may not copy, modify, distribute, sell, license, reverse engineer, or create derivative works from VistralNova materials without prior written permission. Using the Services does not grant you ownership of VistralNova's intellectual property.
If you submit, upload, post, or share content through the Services, you are responsible for that content. You represent that you have the necessary rights to submit the content and that it does not violate any law, third-party right, or these Terms. By submitting content, you grant VistralNova a limited, worldwide, non-exclusive, royalty-free license to use, store, reproduce, display, and process that content only as reasonably necessary to operate, provide, improve, protect, and promote the Services. We may remove content that we believe violates these Terms or creates risk for VistralNova, users, or third parties.
The Services may connect to third-party services, including wallets, blockchain networks, payment providers, analytics tools, cloud providers, APIs, marketplaces, or external websites. VistralNova is not responsible for third-party service availability, third-party errors or security failures, wallet provider issues, blockchain network failures, external website content, or losses caused by third-party platforms or integrations. Your use of third-party services may be governed by separate terms and policies.
Your use of the Services is also governed by our Privacy Policy. We collect, use, disclose, and protect personal information in accordance with applicable privacy laws and our Privacy Policy. In Canada, PIPEDA requires private-sector organizations to handle personal information through fair and lawful means, with consent, and for reasonable stated purposes.
We take reasonable technical and organizational measures to protect our Services and systems. However, no online platform, wallet integration, blockchain network, AI system, or digital service can be guaranteed to be completely secure. You are responsible for using secure devices, trusted wallets, strong passwords, two-factor authentication where available, and safe online practices.
We aim to provide reliable Services, but we do not guarantee uninterrupted or error-free access. The Services may be unavailable due to maintenance, technical issues, security updates, blockchain network congestion, third-party outages, product changes, legal or compliance restrictions, or force majeure events. We may modify, suspend, discontinue, or limit any part of the Services at any time.
Some Services may be released as alpha, beta, preview, testnet, prototype, or experimental features. These features may be incomplete, unstable, or subject to change. They may contain bugs, errors, data loss risks, or unexpected behavior. VistralNova may modify or discontinue beta or experimental features at any time without liability.
The Services, including any AI-generated output, game data, reward information, digital asset information, or platform content, are provided for informational and entertainment purposes. Nothing in the Services should be considered financial advice, investment advice, legal advice, tax advice, betting advice, or professional advice. You should make your own decisions and consult qualified professionals where appropriate.
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, VistralNova disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, accuracy, reliability, and availability. VistralNova does not guarantee that the Services will always be available, will be error-free or secure, AI-generated outputs will always be accurate, digital assets will retain value, blockchain transactions will process successfully, or third-party services will operate without issues.
To the maximum extent permitted by applicable law, VistralNova will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of data, loss of digital assets, loss of goodwill, business interruption, wallet compromise, blockchain transaction failure, third-party service failure, or AI or simulation output errors. VistralNova's total liability for any claim related to the Services will be limited to the amount you paid to VistralNova for the relevant Service during the twelve months before the claim arose, unless applicable law requires otherwise.
You agree to indemnify and hold harmless VistralNova, its directors, officers, employees, contractors, affiliates, service providers, and partners from any claims, damages, losses, liabilities, costs, or expenses arising from: Your use of the Services. Your violation of these Terms. Your violation of applicable laws. Your misuse of digital assets or blockchain features. Your submitted content. Your violation of third-party rights. Your fraud, abuse, or unauthorized activity.
We may suspend, restrict, or terminate your access to the Services if: You violate these Terms. Your activity appears fraudulent, abusive, harmful, or unlawful. You create legal, security, operational, or compliance risk. We are required to do so by law or platform policy. We discontinue or materially change a Service. Termination does not affect rights or obligations that existed before termination.
We may update these Terms from time to time. When we update the Terms, we will revise the effective date. Your continued use of the Services after the updated Terms are posted means you accept the updated Terms. If you do not agree with the updated Terms, you should stop using the Services.
These Terms are governed by the laws of British Columbia, Canada, and the applicable federal laws of Canada. Any disputes arising from these Terms or the Services will be handled by the courts located in British Columbia, Canada, unless applicable law requires otherwise.
